These Terms and Conditions ("Terms") govern your use of the FrontDesk platform ("Service"), operated by Trembita Digital ("we", "our", "us"). By accessing or using FrontDesk, you agree to these Terms.

1. The Service

FrontDesk provides an AI-powered receptionist and appointment scheduling platform for local businesses. Features include an AI phone agent, online booking pages, appointment management, calendar sync, and SMS notifications.

2. Accounts

You must create an account to use FrontDesk as a business operator. You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate information and keep it up to date.

3. Acceptable Use

You agree not to use FrontDesk to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or harassing communications
• Impersonate any person or entity
• Interfere with or disrupt the platform or its infrastructure
• Use the AI agent to deceive callers in a harmful way

4. SMS Messaging Program

How we obtain consent (written, explicit): Operators opt in only by checking a separate, unchecked-by-default consent box in Shop Settings in the FrontDesk portal, next to their notification preferences, after entering a verified mobile number in Profile. That checkbox is labeled: “Yes, text me when appointments are booked or cancelled. Message frequency varies. Msg & data rates may apply. Reply STOP to cancel, HELP for help. By checking this box, I agree to the Terms and Privacy Policy.” End users (customers) opt in only by checking a separate, unchecked-by-default consent box on the Operator's public FrontDesk booking page, shown next to the phone number field, with links to these Terms and our Privacy Policy. No marketing messages are sent — all messages are transactional and directly related to booked appointments. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes (see our Privacy Policy).

5. Intellectual Property

FrontDesk and its content, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written permission.

6. Third-Party Services

FrontDesk integrates with third-party services including Twilio (SMS and voice), Google Calendar, and cloud hosting providers. Use of these integrations is subject to their respective terms of service.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that the AI agent will handle all calls perfectly or that the Service will be uninterrupted or error-free. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, FrontDesk shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including missed appointments, failed communications, or data loss.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may cancel your account at any time by contacting us. Upon termination, your data may be deleted in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts.
